1. Agreement and Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you (individually or on behalf of an apartment building committee) and BashaBill ("we," "our," "us") regarding your access to and use of the BashaBill website (bashabill.com) and Progressive Web Application (PWA).
By registering an account, creating a building portal, or accessing BashaBill as a resident, owner, or visitor, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree, you are prohibited from using the platform.
2. Account Registration & Security
To use our services, you must register by authenticating via Google Auth or other supported methods (such as OTP-based login). You agree to:
- Provide accurate, current, and complete registration and user details.
- Maintain the security of your logged-in session and credentials.
- Promptly notify us if you suspect any unauthorized access to your account.
- Accept responsibility for all activities that occur under your authenticated user account.
3. Platform Description & Service Charge Tracking
BashaBill is a software platform that assists building committees and managers in Bangladesh with billing, service charge recording, and collection management.
Please Note: In its current Phase 1 MVP version, BashaBill is a tracking and ledger tool. BashaBill does not directly process payments, hold bank funds, or escrow service charges. All payments are recorded manually by building administrators when residents settle their dues via Cash, Bank Transfer, or Mobile Financial Services (MFS) like bKash, Nagad, and Rocket.
4. User Roles and Data Entry Accuracy
BashaBill utilizes Role-Based Access Control (RBAC):
- Building Administrators: Admins can configure buildings, flats, resident records, generate bills, add expenses, and log received payments. Admins are solely responsible for the correctness of all entered financial ledger data, billing rates, and payment logs.
- Residents / Flat Owners: Residents can view their flat dashboard, see outstanding bills, check paid histories, and view building expense/collection transparency metrics.
BashaBill acts solely as a data processor for your building's logs. We do not audit, verify, or assume responsibility for incorrect billing figures, disputed payment recordings, or inaccurate phone numbers uploaded by building administrators.
5. Billing, Due Lists, & Manual Payments
Administrators can generate monthly bills based on pre-configured charge types (such as service charge, utility fees, or maintenance). All transactions on BashaBill are tracked in Bangladeshi Taka (BDT).
Residents agree to settle service charge dues with their respective building management committees directly using cash, checks, MFS (bKash, Nagad, etc.), or bank accounts. Once a payment is made, administrators will manually record it on the platform, which will move the bill status from "Issued" or "Overdue" to "Paid."
6. WhatsApp Messaging & Communications Consent
BashaBill offers integration with the Meta WhatsApp Cloud API to send bill notifications and payment reminders.
- Residents acknowledge and consent to receiving automated WhatsApp templates or SMS notices summarizing their flat number, outstanding dues, and due dates.
- Building Administrators represent and warrant that they have secured full consent from residents before inputting their mobile numbers into the platform and triggering automated reminders. BashaBill disclaims any liability arising from unsolicited messages sent via the WhatsApp API integration due to incorrect number entries or lack of resident consent.
7. Acceptable Use and Restrictions
You agree not to use BashaBill to:
- Input fraudulent payment records, false bills, or inaccurate flat ownership details.
- Harass, spam, or abuse any resident or owner with repetitive or unauthorized payment reminders.
- Attempt to breach, circumvent, or compromise the database separation and isolation (multi-tenancy security) of other buildings.
- Use scripts, scrapers, or bots to crawl BashaBill's servers or extract financial information without authorization.
8. Limitation of Liability
To the maximum extent permitted by applicable law, BashaBill shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of revenue, unpaid service charges, community disputes, or financial mismanagement in your building resulting from your use of or inability to use the platform.
BashaBill is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties that the platform will be uninterrupted, error-free, or completely secure from external cyber threats.
9. Suspension and Termination
We reserve the right, in our sole discretion and without notice or liability, to suspend or terminate your account or deny access to a building portal for any violation of these Terms, non-payment of subscription fees (if applicable), or activities that we deem harmful to other tenants or the BashaBill service.
10. Governing Law
These Terms of Service and any dispute arising from your use of BashaBill shall be governed by, and construed in accordance with, the laws of the People's Republic of Bangladesh, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts of Dhaka, Bangladesh.
